Terms of Service

1. Agreement to Terms

By accessing or using mykyara.ai ("the Service"), operated by Mass Tort Ad Agency LLC ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

mykyara.ai provides AI-powered assistant agents accessible via web chat, SMS, voice, and phone. The Service is powered by third-party AI models and is designed to assist with productivity, scheduling, research, and general tasks. The Service is not a substitute for professional legal, medical, financial, or other licensed advice.

3. Accounts & Access

To use the Service, you must purchase access through our authorized payment provider (Lemon Squeezy). You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to use the Service.

4. Pricing & Credits

• Agent access is sold as a one-time purchase. Each purchase includes a starter credit balance.
• AI conversations, SMS messages, voice calls, and phone agent calls consume credits from your balance.
• Chat conversations cost fractions of a penny per message. SMS messages cost approximately $0.01 each. Voice and phone calls cost approximately $0.10–$0.30 per minute.
• When your starter credits are depleted, you can purchase additional credit packs ($10–$100) within the app.
• Credit balances do not expire.
• All prices are in US Dollars.

5. Refund Policy

We offer a 14-day refund policy from the date of your initial purchase. If you are not satisfied with the Service, contact us at support@mykyara.ai within 14 days of purchase for a full refund. Credit pack purchases (top-ups) are non-refundable once credits have been used. See our full Refund Policy for details.

6. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate any person or entity
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for spam, phishing, or other bulk unsolicited communications
• Circumvent usage limits or credit billing
• Use the phone agent feature to harass, defraud, or scam any business or individual

7. AI Limitations

The AI agents may occasionally produce inaccurate, incomplete, or inappropriate responses. You acknowledge that:

• AI-generated content should be reviewed before acting on it
• The Service does not provide professional legal, medical, financial, or tax advice
• We are not liable for actions taken based on AI-generated content
• AI capabilities and performance may vary and are subject to change

8. Intellectual Property

Content you create through the Service belongs to you. The mykyara brand, design, agent characters, and underlying technology remain our property. You may not reproduce, distribute, or create derivative works of the Service without written permission.

9. Privacy

Your use of the Service is subject to our Privacy Policy. We collect and process data as described therein.

10. Termination

We may suspend or terminate your access to the Service at any time for violations of these terms. You may stop using the Service at any time. Unused credits remain in your account but are not redeemable for cash.

11. Limitation of Liability

To the maximum extent permitted by law, mykyara.ai and Mass Tort Ad Agency LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or in-app notification.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Orange County, Florida.
